    The age of criminal responsibility in England and Wales is 10 years and it is not possible to bring criminal proceedings against children below this age. Children between the ages of 10 and 17 charged with committing a criminal offence may be brought before a court, usually a juvenile court. A local authority may bring a child of any age under the age of 17 to a juvenile court in a procedure known as care proceeding if, for example, it suspects that he or she is in moral danger or beyond the control of his or her parents. Under both care and criminal proceedings a court may make a care order or a supervision order or, if the parents consent, an order requiring them to exercise proper care or control over the child. Before an order may be made in care proceedings , it must be shown that the child is in need of care or control, which he or she is unlikely to receive unless the order is made.
    Under a care order a local authority becomes responsible for deciding where the child should be accommodated. It may allow him or her to remain at home under supervision or place him or her with foster parents or in a voluntary or community home. For children too severely disturbed or disruptive to be treated in local authority homes, there are 2 special Youth Treatment Centres run by the department of Health. The authority must review each care order every 6 months and consider whether an application should be made to the court to end it, the order normally expires when the child reaches 18 or 19. When a child who is already under a care order as a result of an offence (for which an adult could be punished by imprisonment) a court may attach a charge and control condition to the order. This suspends for up to six months the local authority’s discretion to place the child in his or her own home, but does not oblige the authority to place the child in a community home. THe local authority may, in example, place the child with foster parents.

    The State Duma has approved the first reading of part IV of the Civil Code, consolidating the norms of in¬tellectual property protection previ¬ously regulated by special laws.
    From January 2008, the Civil Code will come into force, abolish¬ing all other laws on intellectual property. Experts have strongly ob¬jected to the move, saying it will re¬sult in a legal mess, contradictions and troubles protecting the rights of individuals and companies.
    “In most countries intellectual property is regulated by special laws,” Alexander Sergeyev, head of civil leg¬islation department at St. Petersburg State University of Economy and Fi¬nance, said at a round table at Rosbalt news agency Monday.
    “The legislation on intellectual property is changing very fast, while the Civil Code should be a stable le¬gal act. Including the norms of intel¬lectual property protection into the Civil Code will prevent their proper development,” Scrgcycv said.
    He also warned that changing the legislature could prevent Russia from entering the WTO.
    “Existing laws, despite all their weak points, have been analyzed by international experts and consid¬ered as corresponding to interna¬tional standards. Changing the Civil Code just before entering the WTO is like waving a red flag before a bull,” Sergeyev said. Not being spe¬cialists in intellectual property, the law’s authors made a number of mistakes, with contradictions and dubious definitions, experts said.
    Vadim Uskov, patent attorney and head of Uskov & Partners legal firm, described the new law as a “pre-production model.”
    As an example of an obvious mistake, Uskov said the Civil Code does not define what actions could be regarded as an “abuse of trade¬mark.” At the moment that defini¬tion is provided by the Law on Trademarks, which is to be abol¬ished from 2008.

    According to the new law, only Russian residents are allowed to ap¬peal to the courts to protect their in¬tellectual property, which contra¬dicts even the Russian Constitution, Uskov said.
    “Many paragraphs limit the rights of foreign authors and per¬formers,” he said.
    Yelena Nikolayeva, chief special¬ist of the legal department at the Russian Authors’ Society, said that the new law does not limit the num¬ber of organizations that will be able to represent collective authors’ rights. All those organizations will be able to sell licenses.
    “Pirates will not suffer from the new law, while law abiding compa¬nies will get into additional trouble,” said Natalia Panicheva, commercial director of ShnurOK, a company representing the rights of Sergei Shnurov, singer for the group Leningrad.
    Victor Naumov, a member of State Duma expert council on the legal regulation and the protection of intellectual property, en-trepreneurship and tourism, said that the changes in the legislation are unreasonable and premature.
    Even the existing legislature is not yet used on a regular basis, Nau¬mov said. Last year the Arbitration Court investigated about one million cases, and only 999 cases were re¬lated to the protection of intellectual property.
    “Unless the judges understand the new law in detail, they will not start working with it,” Nikolayeva agreed.
    As a potential source of risk Nau¬mov indicated the paragraph on “work products.”
    “According to this law, employ¬ees get considerably more rights than they have in the current legisla¬tion,” Naumov said.
    He recalled the recently created technoparks and the development of a “knowledge economy.” Em¬ployers will face higher risks if em¬ployees are able to contest their rights over the created products, Naumov said.

    Как вспомню адрес, я тебе скину адрес онлайн-переводчика, который мне отлично перевел текст с голландского. Учитывая то, что другие переводчики переводили этот же текст просто безобразно. Думаю, это узконаправленный сайт типа того, который тебе хорошо переводил с польского.

    Гугль перевел название моей статьи “Хорошо подумай прежде чем начать, а то…”, - как “перед началом нужно хорошо выпить”. Это оптимизация под русскоязычное население со стороны буржонета
